The matter has been taken up through video conferencing.

The petitioner seeks bail in Bhagwan Bazar P.S. case No. 226/2020 registered u/s 30(a) of the Bihar Prohibition & Excise Act.

25 liters of illicit liquor was recovered from a bush situated by the side of road. The name of the petitioner surfaced in the case as the informant disclosed that he had received specific inputs that it was the petitioner who was selling illicit liquor by the side of the road.

The learned counsel for the petitioner submits that petitioner was not arrested on the spot and on mere suspicion

Patna High Court CR. MISC. No.21349 of 2020(2) dt.12-08-2020 2/2 the petitioner has been made accused in the case. The petitioner was also made accused in Bhagwan Bazar P.S. case No. 348/2018 but for recovery of 25 liters of illicit liquor from a bush the petitioner is in custody since 19.05.2020. Taking into consideration the facts aforesaid and the fact that petitioner has already remained in custody for more that two and half months, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Saran at Chapra in connection with Bhagwan Bazar P.S. case No. 226 of 2020.
