JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2019 This is an application for grant of anticipatory bail in connection with Dewadha P.S. Case No. 113 of 2018, disclosing offences under Sections 272, 273, 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act 2016. Allegation is of recovery of 3 liters liquor from the motorcycle of the petitioner.

Submission of learned counsel for the petitioner is that nothing has been recovered from his conscious possession and moreover the recovery is from the co-accused, who was arrested on the spot with motorcycle. Further, the petitioner has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above

Patna High Court Cr.Misc. No.1681 of 2019(2) dt.24-01-2019 2/2 named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd A.D.J./Special Judge, Excise Act, Madhubani, in connection with Dewadha P.S. Case No. 113 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
