JUSTICE ARUN KUMAR ORAL ORDER 13-06-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehend her arrest in connection with Bihar P.S. Case No.458 of 2016, registered under Sections 323, 341, 504, 379, 498(A) and 313/34 of the Indian Penal Code as well as Section 3/4 of the Dowry Prohibition Act. Allegation in brief is that the informant was married with one Md. Zahid Khan, brother of the petitioner, and after marriage she was being tortured for further demand of dowry and the specific allegation against the petitioner is that she pinned down the informant on ground by holding her waist, sat on her

Learned counsel for the petitioner submits that the petitioner is unmarried Nanad of the informant. She has been dragged in this case by alleging general and omnibus allegation. The allegation of assaulting on the abdomen of the informant is against the husband of the informant and not against this petitioner.

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Biharsharif (Naland) in connection with Bihar P.S. Case No.458 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
