JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-01-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner seeks bail in Sadar Hajipur P.S. Case No. 592 of 2020, registered for the offence punishable under Sections 376, 376(D) and other allied sections of the Indian Penal Code, sections 3, 4, 5, 6, 7, 9 of the Immoral Traffic (Prevention) Act and section 8/12 of the POCSO Act and section 75/26 JJ Act.

As per the FIR, this petitioner along with other coaccused persons forcibly established sexual relation with the victim/informant.

It is submitted on behalf of the petitioner that charge has already been framed in this case on 13.01.2021 and out of

Patna High Court CR. MISC. No.35263 of 2021(3) dt.27-01-2022 2/2 ten witnesses six witnesses have already been examined on behalf of prosecution. Petitioner is in custody since 18.10.2020 having no criminal antecedent.

Considering the nature of accusation and stage of trial, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
