The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 148, 149, 341, 323, 307, 353, 427 of the Indian Penal Code.

As per the prosecution case, this petitioner alongwith other co-accused created hindrance in construction of road in the village under the scheme of 'Mukhya Mantri Nishchay Yojana' and when the work again resumed, an altercation took place between the parties and two of the police constables received injury.

It is submitted on behalf of petitioner that as a matter of fact, the road in question was being constructed on the private land of petitioner and other co-accused and when the same was objected to by the petitioner and other co-accused, a fight took placed between the parties. It is next submitted that for the same occurrence, two separate F.I.Rs. have been lodged against this petitioner. The present case is Imamganj P.S. Case No. 92/2020 and another case is Imamganj P.S. Case No. 93/2020, in which, petitioner is on bail. Two co-accused i.e. Antu Yadav and Dineshwar Yadav have been granted anticipatory bail by this Court, vide Annexure - 2 to the petition.

Learned A.P.P. for the State has opposed the bail petition.

However, considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., Sherghati, Gaya in connection with Imamganj P.S. Case No. 92 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
