The petitioner seeks regular bail in connection with Khudwan P.S. Case No. 47 of 2013 registered for the offence punishable under Sections 147, 148, 149, 427 and 302 of the Indian Penal Code, Section 27 of the Arms Act, Section 17 of the C.L.A. Act, Section 3⁄4 of the E.S.A. Act, Sections 3, 4 and 5 of the PDPP Act and Sections 10 and 20 of the U.A.P.A. Act. Allegation in brief is that accused persons, members of the extremists group, had put landmine and had exploded the same resulting in the vehicle of the informant's husband having been battered and damaged resulting in death of all the persons travelling in the vehicle.
The learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.2076 of 2019(2) dt.17-01-2019 2/2 petitioner's name was disclosed in the confessional statement of co-accused Vijay Singh, except which, there is no other material as against the petitioner and FIR named accused Vijay Singh and others have already been admitted to bail by a co-ordinate Bench of this Court vide order dated 06.01.2015 passed in Criminal Misc. No. 3841 of 2015. The petitioner is stated to be in custody since 26.07.2016 and Police has submitted charge sheet.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Khudwan P.S. Case No. 47 of 2013.
