The petitioner seeks regular bail in connection with Desari P.S. Case No. 160 of 2020 lodged under Section 392 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R., nothing incriminating has been recovered from the possession of the petitioner, no TIP takes place. It has been submitted that petitioner is in custody since 17.02.2022 having no criminal antecedent. It has also been submitted that the co-accused Pintu Kumar, Vikash Kumar, Vikrant Kumar and Manish Kumar have been granted bail by the Co-ordinate Bench as well as same Bench of this Court in Cr. Misc. No.19421 of 2021, Cr. Misc. No.21050 of 2021, Cr.
Patna High Court CR. MISC. No.24061 of 2022(2) dt.25-07-2022 2/2 Misc. No.20036 of 2022 and Cr. Misc. No.20870 of 2022. Learned counsel for the State opposes the prayer for bail.
Considering the facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-15, Vaishali in connection with Desari P.S. Case No. 160 of 2020, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
