JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.
One co-accused, Dilkhush Jha, was apprehended with illicit liquor and confessed his guilt naming one Mahendra Chaupal, whose house was, subsequently, raided by the police and huge quantity of Indian made foreign liquor was recovered. However, the aforesaid Mahendra Chaupal disclosed that the seized article had been kept in his house by one Chande Chaupal and the petitioner. It appears that except the aforesaid material there is nothing against the petitioner. The petitioner does not have any criminal antecedents and is languishing in jail
Patna High Court Cr.Misc. No.78755 of 2018(2) dt.18-01-2019 2/2 custody since 21.9.2018.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II - cum - Special Judge, Excise Act, Madhubani in connection with Madhepur P.S. Case No. 101/2018.
