====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-04-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Buxar (T) P.S. Case No.125 of 2019 registered under Section 30(a) of the Bihar Excise (Amendment) Act, 2018.

The accusation is of recovery of 38 bottles, each containing 180 ml. Indian Made Foreign Liquor, from the courtyard of the house of the petitioner.

Learned counsel appearing on behalf of the petitioner submits that the house from where the alleged is said to be made is the joint family house of the petitioner. The petitioner having no criminal antecedent is in custody since 18.02.2019. Having regard to the facts and the circumstances of

No.23653 of 2019(2) dt.12-04-2019 2/2 the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Buxar, in connection with Buxar (T) P.S. Case No.125 of 2019. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
