The petitioner apprehends his arrest in Gandhi Maidan P.S. Case No.118 of 2016 registered under Sections 420, 467, 468, 471 and 120-B of the Indian Penal Code. As per the prosecution case, the petitioner is said to have defalcated the amount of scholarship in connivance with the government officials.
It has been submitted by learned counsel for the petitioner that the petitioner is innocent and has committed no offence. The alleged defalcated amount to tune of Rs.15 lakhs and odd had been recovered in cash in the school premises and the Principal of the said school, namely, Rajiv Ranjan has been enlarged on anticipatory by a coordinate Bench of this Court in Cr.
Patna High Court Cr.Misc. No.27965 of 2017 (02) dt.22-06-2017 2/2 Misc. No.26558 of 2016 vide order dated 11.08.2016. Considering the facts aforesaid and the nature of allegation as made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000.00 (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned A.C.J.M., Patna in Gandhi Maidan P.S.
