JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-06-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 506, 504, 34 of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution case is that on 15.01.2016 at 6:30 P.M when the informant was coming from his village the petitioner fired and escaped from the scene and thereafter younger brother of the petitioner assaulted with khanti causing injury on the left eye of the informant.
It is submitted by learned counsel for the petitioner that informant received four lacerated injuries and none of the four injuries have been found to be caused by fire arm. The petitioner's side lodged the case against the informant at earlier point of time.
A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.25652 of 2016 (2) dt.29-06-2016 2/2 petition that petitioner has no criminal antecedent. Considering the accusation not being corroborated with the medical opinion, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Sahar P.S. Case No. 8 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
