JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Dariyapur P.S. Case No. 361 of 2018 registered for the offences punishable under Sections 30, 30(a), 38 and 41 of Bihar Prohibition and Excise Act.

Allegation is of recovery of 532 litres of liquor from the back side of Dalan of the petitioner. Submission of learned counsel for the petitioner is that nothing has been recovered from his possession.

Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioner stating that

Patna High Court Cr.Misc. No.78986 of 2018(3) dt.20-02-2019 2/2 petitioner has criminal antecedent and he has suppressed the fact.

Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner. Prayer for anticipatory bail is rejected.

This application is, accordingly, dismissed.
