1. Heard learned counsel for the petitioner as well as learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 427, 307, 379, 385, 387 and 34 of the IPC in connection with Bhabua P.S. Case No.09 of 2024.

3. The learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the instant case by the informant. It is next submitted that petitioner is owner of a truck while informant is an owner of a harvester and there was a dispute on the road in

Patna High Court CR. MISC. No.25674 of 2024(2) dt.02-05-2024 2/3 between the informant and the son of the petitioner namely, Deva Yadav. Further on account of altercation Deva Yadav is alleged to have assaulted the informant by an iron rod causing injury on head. It is next submitted that petitioner on coming to know that his son has indulged in a fight with the informant as such he came to be pacify when he was also implicated in the instant case with a general and omnibus allegation that he snatched Rs.56,000/- which the informant was carrying after selling food grains. It is further submitted that Deva Yadav is not a petitioner in the instant case. It is next submitted that allegation of snatching money is ornamental.

4. The learned APP opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner and the fact that petitioner is a person with clean antecedent, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No.09 of 2024,

Patna High Court CR. MISC. No.25674 of 2024(2) dt.02-05-2024 3/3 subject to the conditions laid down under Section 438(2) of the Cr.P.C.

6. The application stands allowed.
