JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-06-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 366A of the Indian Penal Code.

The prosecution case is of abducting the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that the victim in her 164 Cr.P.C statement stated that Kundan Mandal abducted her forcefully and kept her in the house of Sunil Mandal and after two days took her to anganbari centre from where Pugeshwar Mandal, the uncle of co-accused Kundal Mandal got the victim released. It is further submitted that victim has not named the petitioner. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. No.25658 of 2016 (2) dt.29-06-2016 2/2 petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bhagalpur in connection with Nath Nagar P.S. Case No. 129 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
