JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2019 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in Hawai Adda (Airport) P.S. Case no. 170/2016 registered under sections 364 and 120B of the IPC.

It would appear from perusal of the impugned order that learned Addl. Sessions Judge V, Patna disposed of bail petition of the petitioner without perusing the case diary and without mentioning anything in the impugned order dated 9.10.2018. Therefore, in the aforesaid circumstance, this petition stands dismissed giving liberty to the petitioner to file a fresh bail petition before the learned Sessions Judge, Patna and if the petitioner does so, learned Sessions Judge, Patna/ the concerned
