====================================================== CORAM: HONOURABLE MR. JUSTICE VIKASH JAIN ORAL ORDER 24-02-2021 Heard learned counsel for the petitioner and learned APP for the State. Learned counsel for the petitioner hereby undertakes to remove all defects pointed out by the Stamp Reporter as and when required. It is accordingly directed that all defects pointed out by the Stamp Reporter be removed within one month hereof.

2. The petitioner, who is in custody since 14.11.2019, has renewed his prayer for bail in connection with Bhagwanpur P.S.Case No. 250 of 2018, having earlier been rejected by order dated 17.03.2020 in Cr. Misc. No. 84132 of 2019 for the alleged offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. It is submitted that the petitioner has been falsely implicated in connection with recovery of 4263 litres of foreign

Patna High Court CR. MISC. No.23682 of 2020(3) dt.24-02-2021 2/2 wine from a truck on the basis of the confessional statement of co-accused Randhir Kumar @ Mintu Kumar. It is stated that the petitioner was in custody at the relevant time in connection with Bhagwanpur P.S.Case No. 199 of 2018, in which he has been granted bail by this Court in Cr.Misc. No.72164 of 2018.

4. Having regard to the nature of accusations and gravity of offence alleged as well as the quantity of the liquor recovered, this Court is not inclined to take a different view in the matter of granting bail to the petitioner. The bail petition stands dismissed with liberty to renew his prayer for bail after framing of charge.

5. Office shall follow-up to ensure that all defects are removed and compliance with the notices of this Court are made by the petitioner within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
