This is an application for grant of regular bail filed on behalf of the petitioners. Petitioners are in custody in connection with Rail Sonepur (Hajipur) PS Case No. 95 of 2018 for the alleged offence punishable under Sections 385, 201, 120B of the Indian Penal Code and Sections 20(b)(ii)(c), 29, 8, 20 and 22 of the NDPS Act.

Allegation in the instant case is that 9 kg.900 gm and 10 kg. 950 gm. Ganja was recovered from the possession of the petitioners. Learned counsel appearing for the petitioners submits that petitioners have no criminal antecedent and they are in custody since 31.07.2018.

No.1220 of 2019(2) dt.05-02-2019 2/2 Considering the fact that petitioners have no criminal antecedent and they have remained in custody for nearly six months, this application is allowed. Accordingly, let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of District & Sessions Judge, Vaishali at Hajipur in connection with Rail Sonepur (Hajipur) PS Case No. 95 of 2018 subject to the condition that bailors should be the local people having sufficient immovable property.
