JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-06-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 448, 341, 323, 354(B), 379, 504, 506/34 of the Indian Penal Code. The prosecution case is that on 28.04.2016 when the informant was alone in the house, the petitioner entered into the house, caught hold her hairs and thrashed her on the ground. It is alleged that the accused tore the blouse of the informant and due to the assault she received bleeding injury. Subsequently co-accused Indrajeet Tiwary snatched gold chain of the informant.

It is submitted by learned counsel for the petitioner that husband of the informant and the petitioner are own brothers. The petitioner is 86 years of age. The informant's side were pressurizing the petitioner to transfer certain land and on refusal of the same the petitioner has been roped in the

Patna High Court Cr.Misc. No.25584 of 2016 (2) dt.28-06-2016 2/2 present case. For the occurrence of 28.04.2016 the F.I.R was registered on 30.04.2016.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the delayed lodging of the case, the relationship between the parties, petitioner having no criminal antecedent and the advanced age of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Vth, Katihar in connection with Barari P.S. Case No. 96 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
