Heard the learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Bagaha P.S. Case No. 561 of 2018, registered for the offences punishable under Sections 420, 467, 468, 471, 406 of the Indian Penal Code and Section 138 N.I. Act. As per allegation, the cheque issued by the petitioner in favour of the informant was dishonoured by the Bank. Both the parties have compromised the case in Patna High Court Mediation Centre. Patna High Court CR. MISC. No.24119 of 2022(3) dt.19-01-2023 2/2 has been mentioned in the report of mediator, which is annexed with the record.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bettiah, West Champaran in connection with Bagaha P.S. Case No. 561 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The lower court shall confirm the bail bond after deposit of the 3rd installment.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
