28-09-2021 Heard learned counsel for the parties.

The petitioners seek bail in Sasaram (Twon) P.S. Case No. 690 of 2020, registered for the offence under Section 399, 402 of the IPC, Sections 25(1-B)a, 26, 35 of the Arms Act and Section 4/5 of Explosive Substance Act.

On a secret informant that some miscreants have assembled at the door of Krishna Kahar @ Challu Kahar and are making plan for committing dacoity, a raid was conducted and six persons including these petitioners were arrested on the spot and arms and ammunition were also recovered from their possession.

It is submitted on behalf of petitioners that no arms or ammunition has been recovered from the possession of the petitioners. Arms and ammunition have been recovered from the

Patna High Court CR. MISC. No.35709 of 2021(3) dt.28-09-2021 2/2 possession of other co-accused persons. Petitioners have got clean antecedent and they are in custody since 18.10.2020. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of concerned court where the case is pending in connection with Sasaram (Town) P.S. Case No. 690 of 2020, on the following conditions: "(1) Petitioners shall cooperate in the trial and shall be properly represented on each and every date fixed by the court below and shall remain physically present, as directed by the court below, and on their absence on two consecutive dates without sufficient reason, their bail-bond shall be cancelled by the court below.

(2) If the petitioners tamper with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
