JUSTICE BIRENDRA KUMAR ORAL ORDER 19-08-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.

After cremation of the dead body of the victim-lady, the FIR was lodged under Sections 304B and 201/34 of the Indian Penal Code. Husband of the victim was granted regular bail in Cr. Misc. No. 2804 of 2014 on 25.03.2014 and a Coordinate Bench had noticed that when the husband refused to care his minor daughter, the FIR was lodged.

Considering the aforesaid facts, let the petitioners,

Patna High Court Cr.Misc. No.33257 of 2017 (3) dt.19-08-2017 2/2 above named, who are relations of the husband, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj/successor Court in connection with Bhorey Police Station Case No. 119 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
