JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2019 This is an application for grant of anticipatory bail in connection with Chapra (Town) P.S. Case No. 296 of 2016, disclosing offences under Sections 120(B), 323, 504, 420, 467, 468, 471 and 386 of the Indian Penal Code.

Allegation as per complaint petition is that the complainant has purchased the land from one Umesh Singh, who has power of attorney holder of one Jai Ram and it is alleged that the complainant has made construction on the said land, then the petitioners came over the land and threatened the complainant and did not allow him to construct the land and also snatched Rs.5000/- from the complainant. Submission of learned counsel for the petitioners is

Patna High Court Cr.Misc. No.77875 of 2018(2) dt.03-01-2019 2/2 that the petitioners are also purchasers of the land from another power of attorney holder of Jai Ram and proceedings under Section 144 Cr.P.C. has been decided in favour of the petitioners, which will clear from Annexure-2. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra, in connection with Chapra (Town) P.S.
