08-12-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Gopalpur P.S. Case No. 191 of 2020, registered for the offence under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, the FIR named accused persons committed the murder of brother of the informant. Petitioner is not named in the FIR. Name of the petitioner has transpired during course of investigation on the basis of fact that this petitioner, who was having a mobile shop, had activated a fake SIM Card, bearing number 7739867052, in the name of one Md. Tavrej Ansari and said number was used in the aforesaid crime. Petitioner is not alleged to be involved in commission of murder of deceased and he is in custody since 05.01.2021.

Learned A.P.P. for the State has opposed the bail

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - IX, Patna in connection with Gopalpur P.S. Case No. 191 of 2020.
