Heard learned counsel for the petitioner and the learned A.P.P. for the State. No one appears on behalf of the complainant. The petitioner apprehends his arrest in connection with Complaint Case No.574 of 2013 registered under Section 494 and 498(A) of the Indian Penal Code besides Sections 3/4 of the Dowry Prohibition Act.

The accusation against all the accused persons including the petitioner, who is the husband of the complainant, is of torturing the complainant for non fulfillment of the dowry demand. There is also allegation against the petitioner of

Patna High Court Cr.Misc. No.46024 of 2014 (4) dt.25-06-2015 2/2 performing remarriage with another lady.

Learned counsel appearing on behalf of the petitioner submits that due to misunderstanding in between the petitioner and the complainant, the petitioner performed remarriage and the complainant has also performed remarriage with another person, namely, Anand Das, son of Bhantu Das, resident of village-Siriya, Post-Pabhera, P.S. Dhanarua, District-Patna, on 26.01.2015 and the complainant is living with her second husband in villageSiriya, regarding which a certificate has been issued by the Member of the Panchayat Samiti of Chhotaki Math (Annexure-'A' to the supplementary affidavit filed on behalf of the petitioner). Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Jehanabad, District-Jehanabad, in connection with Complaint Case No.574 of 2013, subject to the conditions laid down under Section 438(2) Cr.P.C.
