JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under Sections 341, 323, 452, 447, 354, 386, 387 and 34 of the Indian Penal Code and section 27 of the Arms Act.
It is alleged by the informant that the petitioner along with other accused Pankaj Yadav and Harkhit Yadav accosted her and her daughter-in-law and demanded extortion money from her for doing fishing from the pond. It is alleged that accused Pankaj Yadav pointed pistol and abused her and due to fear she paid a sum of Rs.42,000/-. It is alleged that the petitioner slapped her. The petitioner submits that the instant case is a counter blast to the earlier case lodged by him against the sons of the informant. The allegations against the petitioners are more or less similar to
Patna High Court Cr.Misc. No.25700 of 2016 (2) dt.12-07-2016 that of allegation lodged by the petitioner.
Having regard to the facts and circumstances of the case, the petitioner, Rupesh Yadav @ Rupesh Kumar, is directed to be released on anticipatory bail, in the event of his arrest/surrender, in connection with Sahebpur Kamal P.S. Case No.402 of 2015, on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of the A.C.J.M.-V, Begusarai. (Samarendra Pratap Singh, J) KHAN/- U
