ANJANA MISHRA ORAL ORDER 27-07-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Mohania P.S. Case No.379 of 2016 for allegedly having committed the offence under Sections 409 and 420 of the Indian Penal Code.

Diary in the present case was called for, which has since been received.

After hearing the learned counsel for the petitioner and the learned counsel for the State it appears that during the course of investigation at paragraph 82 of the case diary, the investigating officer has come to a finding that no rice remains due from the present petitioner and thus, no case as alleged is

Considering the fact that the petitioner has been found to have submitted the rice, which is required to be submitted by him and nothing remains due to the petitioner as on the date of such investigation, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur, in connection with Mohania P.S. Case No.379 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
