2. The petitioner seeks bail in connection with Buxar Town P.S. Case No. 66 of 2024 registered for the offence under Sections 341, 323, 307, 120B/34 of the Indian Penal Code and under Section 27 of the Arms Act.
3. As per the prosecution case, unknown criminals have shot at the victim.
4. The petitioner is the manager of the petrol pump owned by the victim and it has come during investigation that the petitioner had defalcated Rs. 40 lakhs from the petrol pump and when the defalcation was detected, the petitioner hired some
Patna High Court CR. MISC. No.30195 of 2024(3) dt.31-07-2024 2/2 criminals to kill the owner of the petrol pump who is victim in this case. One attempt was taken by the hired criminals but the victim survived. Again, second attempt was made and the victim has sustained injuries.
5. During the investigation, the pistol used in the crime has been recovered from the statement of the petitioner from his house. After analysis of the CDR, it has come that the petitioner was in touch of the assailants of the victim.
6. Considering the aforesaid facts, this Court is not inclined to grant bail to the petitioner.
7. Accordingly, this application is dismissed.
8. The Court below is directed to expedite the trial of the petitioner and conclude the same at the earliest. (Sandeep Kumar, J) Vikas/- U
