In this application for anticipatory bail the petitioner apprehends his arrest in connection with Sirdala (Meskaur) P.S. Case No. 142 of 2016 for the offences punishable under sections 323, 379 and 498 (A) of the I.P.C and section 3⁄4 of the Dowry Prohibition Act.
The Mediator's report has been received. The dispute between the parties has been resolved amicably through the process of mediation. The terms of the settlement mutually agreed
Patna High Court Cr.Misc. No.1570 of 2017 (4) dt.29-06-2017 2/2 upon by the parties is on the separate sheet which is attached with the Mediator's report.
As per the settlement both parties are living together and now there is no dispute between them. Both are agreed to get the cases resolved according to the settlement. The learned counsel for the petitioner is present. The learned counsel for the opposite party no.2 is also present who has got no objection in granting bail to the petitioner. It reveals that in view of settlement arrived at between the parties the opposite party no.2 has not appeared. The learned counsel for the petitioner submits that both parties are living together peacefully. Under the circumstances, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. Shri Sabir Kumar, A.C.J.M-Vth, Nawada in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
