The petitioner, who is an accused of Supaul P.S. Case No. 352 of 2013, seeks transfer of the case from Chief Judicial Magistrate, Supaul to any other Court of Competent Jurisdiction within sessions division of Patna on the ground that he apprehends danger to life from the prosecution party because they still aggrieved with their daughter having married the petitioner out of her own sweet will.
Be that as it may, in the interest of justice, let the records of Supaul P.S. Case No. 352 of 2013 pending before the
Patna High Court Cr.Misc. No.47185 of 2015 (4) dt.22-01-2016 Chief Judicial Magistrate, Supaul, in the Sessions Division of Supaul be transferred to the Sessions Division Patna within a period of three weeks from the date of this order. The Court at Patna shall examine the alleged victim as first witness and thereafter, pass appropriate orders as to whether any offence is made out in the facts of the case.
With the aforesaid observation, the application stands disposed of.
