Heard Mr. Anand Kishore Choudhary, learned counsel for the petitioner and learned counsel for the State. This application under Section 482 of the Code of Criminal Procedure has been filed for quashing of the order dated 12.01.2017 passed by the learned 2nd Additional Sessions Judge, Bagaha, West Champaran in Cr. Revision No.44 C of 2016 whereby the revisional court has set aside the order of the learned Sub Divisional Magistrate, Bagaha dated 05.01.2016 passed in
Patna High Court Cr.Misc. No.24946 of 2017 (2) dt.28-06-2017 2 / 2 Case No. 260 of 2015 under Section 147 of the Code of Criminal Procedure and remanded back for fresh order after taking evidence of both the parties in the case.
After some arguments, learned counsel for the petitioner seeks leave to withdraw the present application in order to raise all his plea before the Sub Divisional Magistrate before whom the matter has been remanded back.
Leave is granted.
