The petitioner apprehends her arrest in a case registered for the offence under Sections 409, 419, 420, 34 of the Indian Penal Code.
The prosecution case, in brief, is that this petitioner alongwith other co-accused persons misappropriated the fund under the Nal Jal Yojna. They got only half of the said scheme executed and thereafter, left the work incomplete and in spite of several reminders from the authority concerned to get the remaining work completed, the petitioner including others did not pay heed. Petitioner is ward member of the concerned ward. It is submitted on behalf of petitioner that after investigation, the B.D.O., Saraiya, District - Muzaffarpur has issued a letter, vide letter no. 1612 dated 16.10.2021, on the
Patna High Court CR. MISC. No.35034 of 2021(3) dt.30-06-2022 2/2 basis of a joint inquiry report dated 16.10.2021 submitted by Block Panchayat Raj Padadhikari, Saraiya and incharge Statistics Officer, Saraiya regarding completion of work in question under the aforesaid scheme. In support of the same, Annexure 6 series to the supplementary affidavit has been brought on record. Petitioner has got clean antecedent. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur in connection with Saraiya P.S. Case No. 858 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
