2. The petitioners have preferred this application for grant of regular bail in connection with Medni Chowki P.S. Case No. 69 of 2012 registered for the offences punishable u/s 395 and 412 of the I.P.C.

3. As per the prosecution case, some unknown miscreants are alleged to have committed loot in the house of the informant and took away cash of Rs. 15,000/- and some costly utensils, clothes and mobile phones.

4. Learned counsel for the petitioners has submitted that the petitioners are not named in the FIR and their names have surfaced in the confessional statement of the co-accused Vivek Kumar. It is further submitted that no incriminating article has been recovered from the conscious possession of the petitioners and till date no TIP has been conducted. It is lastly submitted that the petitioner Anil Ram has one criminal antecedent whereas the petitioner Alok Sahni has clean antecedent and both are in custody since 08.01.2025.

Learned APP for the State has vehemently opposed the prayer for bail and submitted that there is an allegation against the petitioners of committing theft in the house of the informant and the petitioner, namely, Anil Ram has one criminal antecedent of similar nature of offence. It is further stated that the present case is of the year 2012 and the charge sheet has been submitted against some accused persons u/s 395/412 of the I.P.C. and the case has also been found true against both the petitioners. Patna High Court CR. MISC. No.21728 of 2025(3) dt.17-07-2025 3/3 preferred Anticipatory bail application in 2013 and after the rejection of their bail application both the petitioners did not surrender rather absconded for next more than 12 years and as such they should not be released on bail.

6. Considering the aforesaid facts and circumstances of the case and also considering the fact that the petitioners absconded for more than twelve years after rejection of their bail application, this court is not inclined to grant bail to the petitioners and the same is hereby rejected.
