JUSTICE ARUN KUMAR ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends his arrest in connection with Jamhor P.S. Case No.15 of 2017 registered under Sections 379, 411, 420, 406/34 of the Indian Penal Code, Sections 33, 41, 42 of the Indian Forest Act as well as Sections 3, 4 and 5 of the Bihar Minerals Act.

Allegation is that police recovered illegal stone chips from the truck of the petitioner, no paper relating to stone chips was produced.

Learned counsel for the petitioner submits that petitioner is the owner of one of the trucks loaded with stone chips seized by the police and it is the driver who was transporting stone chips and the petitioner had no knowledge about it.

No.30297 of 2017 (2) dt.06-07-2017 2 / 2 Considering the nature of allegation that illegal stone chips was being carried away in the truck of the petitioner, the prayer for anticipatory bail of the petitioner is refused in connection with Jamhor P.S. Case No.15 of 2017, pending in the court of the learned Chief Judicial Magistrate, Aurangabad However, if the petitioner surrenders and seeks regular bail, the same shall be considered on merit without being prejudiced by this order.
