JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-02-2016 At the very out set, learned counsel appearing on behalf of the petitioners submits that the petitioner no.5, Subhesh Kumar Singh @ Subhesh @ Sivesh Kumar Singh is a juvenile, which is disclosed in para 10 of the petition and he does not want to press the prayer of bail.
In that view of the matter, learned counsel for the petitioners prays for permission to withdraw the application in respect of petitioner no.5.
Permission is accorded.

Patna High Court Cr.Misc. No.47172 of 2015 (3) dt.17-02-2016 2/3 Sivesh Kumar Singh, is dismissed as withdrawn. Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Rahika P.S. Case No.148 of 2014, registered under Sections 147, 148, 149, 341, 323, 379, 353, 504, 506 and 384 of the Indian Penal Code.
The accusation is that on 28.10.2014 petitioners along with 4-5 others entered into the school, where the informant Bikeshwar Thakur is a teacher, and they started to search the headmaster and also abused him. On hearing of hulla, four other teachers started to flee away, when the informant started to move from his cycle, he was apprehended by the accused persons and he was taken in office of the school, where the accused persons damaged some registers and also assaulted the informant lying him on the earth and they also got the signature of the informant on plain papers giving threatening.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners, above named, accordingly, the prayer of the petitioners for grant of anticipatory bail stands rejected. The petitioners are directed to surrender
Patna High Court Cr.Misc. No.47172 of 2015 (3) dt.17-02-2016 3/3 before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court. (Rajendra Kumar Mishra, J) manish/- U T
