The petitioner apprehends his arrest in connection with Ariyari (Kasar) P.S. Case No. 170 of 2012 registered under Sections 420/120(B)/34 of the I.P.C. and section 47(A) of the Excise Act.

The accusation is that the Police seized 9 packets of country-made liquor from the bus, which was claimed by Jitendra Prasad, one of the staff of licensee wine shop run by wife of Naresh Mahto. Later on, name of the petitioner and others had come, who used to take the country-made wine from the shop for selling the other places.

Learned counsel for the petitioners submits that it would appear from the F.I.R. that while the name of the petitioner and others have been disclosed by co-accused Jitendra Prasad and

Patna High Court Cr.Misc. No.47095 of 2015 (2) dt.16-10-2015 2/2 Sanjay Kumar but nothing has been recovered from the possession of the petitioner by the Police. It is also submitted that petitioners have falsely been implicated in this case.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender within six weeks, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Sheikhpura in connection with Ariyari (Kasar) P.S. Case No. 170 of 2012, subject to the conditions laid down under Section 438(2) Cr. P.C.
