09-09-2020 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor through video conferencing. This relates to grant of regular bail in Bikramganj P.S. Case No. 192 of 2019, registered for the offence under Sections 304(B), 201, 34 of the Indian Penal Code. As per prosecution case, daughter of the informant was married with co-accused Pawan Kumar @ Munna in the year 2016 and after the marriage, all the accused persons started demand of Rs. Three lacs, as dowry, and due to non-fulfillment of the same, the daughter of the informant was subjected to cruelty and harassment. It is alleged that on 15-03-2019, all the accused persons killed the daughter of the informant by pressing her neck.
It is submitted on behalf of petitioner that petitioner is
Patna High Court CR. MISC. No.23200 of 2020(2) dt.09-09-2020 2/2 innocent and has committed no offence. Petitioner is elder brother-in-law (HkSalwj) of the deceased and he was living separately. It is further submitted that petitioner has no concern either with his parents or with family affairs of his brother/deceased. The petitioner is in custody since 06-01-2020, having no criminal antecedent.
Considering the aforesaid facts and circumstances, the bail application is allowed.
Let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Bikramganj, Rohtas in connection with Bikramganj P.S. Case No. 192 of 2019 on the following conditions: "(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the Court below.
(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
