JUSTICE SUDHIR SINGH ORAL ORDER 18-03-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with SC/ST (Bhabua) P.S. Case No. 10 of 2015 for the offences instituted under Sections 341, 323, 504, 506 of the IPC, 27 of the Arms Act and 3(1)(S) of the SC/ST (Prevention of Atrocities) Act.

The prosecution story, in brief, is that while the entertainment programme was going on in the house of the informant, the accused persons came and assaulted the informant and insulted by abusing with caste name.

Patna High Court Cr.Misc. No.46977 of 2015 (5) dt.18-03-2016 2/2 It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. A complaint was filed before the Circle Officer, Kudra, by the petitioners making an allegation that the informant and his family members were encroaching upon the public land. Hence, the present case has been instituted in retaliation to the said complaint. The complaint made by the petitioners is Annexure-2 to the present application. No offence is made out under SC/ST Act.

On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with SC/ST (Bhabua) P.S. Case No. 10/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Ist Class, J.M. Bhabua, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
