The petitioners apprehend arrest in connection with Barauni P.S. Case No. 333 of 2016 registered under Sections 147, 148, 149, 353, 504, 427 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioners submits that the allegations levelled are general and omnibus. There is no allegation of assault to any one. In fact, just after the incidence the Circle Officer-Informant wrote letter (Annexure-2) to the Sub Divisional Officer, Begusarai that encroachers have suo motu left the encroached Rasta and there is

Patna High Court Cr.Misc. No.29426 of 2017 (2) dt.06-07-2017 no dispute remaining. Except petitioner no. 3 all the petitioners have clean antecedent.

Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Barauni P.S. Case No. 333 of 2016 subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) Manish/- U T
