The petitioners, namely, Dhruv Sah and Driber Shoni @ Driber Shahi, apprehend their arrest in Barhariya P.S. Case No. 228/2015 registered under Section 307 and other sections of the Indian Penal Code.

Petitioner no. 1 Dhruv Sah is alleged to have assaulted the informant with iron rod on his head and petitioner no. 2 Driber Shoni is alleged to assaulted the informant with sword on his head. It is submitted that the injuries are simple although the nature of injuries is not mentioned in the injury report. There is a counter-version, being Complaint Case No. 1998/2015. The petitioners are neighbours. Some scuffle took place between the two sides on a petty dispute.

No.28011 of 2016 (2) dt.02-09-2016 2/2 Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in Barhariya P.S. Case No. 228/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
