The petitioner apprehends his arrest in connection with Baheri P.S. Case No. 112 of 2015 registered under Sections 448, 341, 323, 504, 354 and 307/34 of the Indian Penal Code. The prosecution case is that informant Moni Kumari was at her door on 01.06.2015 at about 10.00 am., the petitioner along with 4 others reached at her door, where petitioner asked to lift the informant, thereafter, they started to cause injury through butt of the pistol at the head of the informant, in which she sustained injury and fell down. When brother of the informant Pawan Kumar Singh came to save her, he was also assaulted by the petitioner and others.

No.47248 of 2015 (2) dt.28-01-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that in fact, there is land dispute in between the petitioner and father of the informant and at the time of occurrence, the construction was going on the land of the petitioner, in which the father of the informant and others made protest. In that course, scuffle and hot talk were exchanged, in which the petitioner also sustained injury and on the basis of the written report, Baheri P.S. Case No. 112 of 2015 is instituted on 02.06.2015. Moreover, the injuries, as found on the person of the informant and his brother, are simple in nature.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Darbhanga in connection with Baheri P.S. Case No. 112 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
