JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-03-2018 Heard the learned counsel for the petitioner and Mr. Santosh Kumar Pandey, learned counsel for the Vigilance. This is an application for grant of anticipatory bail in connection with Arwal P.S. Case No. 57 of 2017 registered for the offence punishable under Sections 419, 420, 467, 468, 471 and 120(B) of the Indian Penal Code.

There is allegation against this petitioner that the name of the father of this petitioner has been mentioned in matriculation certificate as Radhey Shyam Singh, whereas in the application form and in the result of BETET, the name of the father of the petitioner has been mentioned as Beshlal Singh. It has been alleged that Panchayat Secretary Ayub Ansari and others have appointed the petitioner fraudulently on the basis of forged and

It has been mentioned in para 9 of the petition that father of the petitioner is also known by the name of Radheshyam Singh which is the alias name and the same has been mentioned in the application form of BETET and accordingly in the result, the father's name of the petitioner was mentioned as Radheshyam Singh. Moreover, from the written report itself, it appears that all the certificates were checked and verified before appointment by the appropriate authorities.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of her arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Arwal in connection with Arwal P.S. Case No. 57 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
