JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-04-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 420, 467, 468, 414 and 401/34 of the Indian Penal Code.
Petitioner does not have any criminal antecedent, which is evident from perusal of paragraph 3 of the petition. Furthermore, the petitioner is in jail custody since 4.12.2018 on the accusation that he and two others were caught with stolen motorcycle, whereas one person managed to escape from the place of occurrence.
Learned counsel appearing for petitioner submits that the first information report goes to show that it was apprehended co-accused Suraj, who confessed before the informant that the
Patna High Court CR. MISC. No.23902 of 2019(2) dt.15-04-2019 2/2 seized motorcycle was stolen by him and he as well as others were going to sell the aforesaid stolen motorcycle. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Hilsa/concerned court in connection with Parwalpur P.S. Case No. 191 of 2018.
