ANJANA MISHRA ORAL ORDER 21-07-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State Food Corporation as well as learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 406/409/420 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been charged with a defalcation of about Rs. 16,63,977/- which is equivalent with the deficit CMR which was required to be given by him. It is further submitted that in the instance case, there is some wrong calculation and the petitioner is willing to cooperate in the investigation and he shall submit all documents to establish that he has given back all rice as was required by him.

No.27847 of 2016 (2) dt.21-07-2016 P2/2 Considering the aforementioned facts and circumstances, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Baroon P.S. Case No. 77/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. It is directed that the petitioner shall make himself available within four weeks with the State Food Corporation to explain the discrepancies as have cropped up in the account of the State Food Corporation and be available at all material times to ensure that the State is not prejudiced in any manner.
