2. The present criminal miscellaneous application has been filed for grant of regular bail to the petitioner who is in custody in connection with Banmankhi P.S. Case No. 269 of 2023, lodged on 12.06.2023, under Sections 363, 366A, 376, 323, 504/34 of Indian Panel Code, under Section 4/6 of the POCSO Act and under Sections 3(i)(R)(S)3(2)(V) of the SC/ST Act.

3. Earlier bail application of the petitioner was rejected vide order dated 18.01.2024 passed in Cr. Appeal (S.J.)

Patna High Court CR. MISC. No.25562 of 2025(9) dt.08-05-2026 2/2 No. 5060 of 2023.

4. Learned Senior Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned Senior Counsel submits that evidence of the victim has taken place and there is no need to keep the petitioner in custody as the petitioner is in custody since 14.06.2023.

5. Learned Counsel for the informant and State both submits that evidence of victim has taken place, who deposed against the petitioner. There is allegation of rape against the petitioner.

6. In this background, this Court is not inclined to grant bail to the petitioner. Hence, the prayer for bail of the petitioner is hereby refused.
