No one appears for the State.
The petitioners are apprehending their arrest in Nardiganj P.S. Case No. 157/2016 registered under Sections 147, 148, 149, 341, 323 and 307 of the Indian Penal Code read with Section 27 of the Arms Act.
Learned counsel for the petitioners submits that the allegations insofar as the present petitioners are concerned are general and omnibus and similarly situated accused have been granted anticipatory bail in Cr. Misc. No. 14813/2017 by a co-
Patna High Court Cr.Misc. No.15867 of 2017 (2) dt.14-06-2017 2/3 ordinate bench of this Court.
Learned counsel appearing on behalf of the informant though opposed the prayer for bail but could not distinguish the case of the present petitioners from that of those who have been granted the privilege of anticipatory bail.
Considering the facts and circumstances of the case, the petitioners, namely, Pintu Singh, Raju @ Rajendra Singh @ Rajendra Kumar and Kripal Kumar @ Kripal Singh, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Nawada VI in connection with Nardiganj P.S. Case No. 157/16, subject to the conditions under Section 438(2) of the Code of Criminal Procedure as also the following conditions:
(i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court;
(ii) The petitioners will not induce any witness or tamper with the evidence; and
