The petitioner apprehends his arrest in Sarmera P.S. Case No.118/16 registered under Sections 420, 409 and 120 B of the Indian Penal Code.

As per the prosecution case, the Block Agriculture Officer, Sarmera, namely, Rajesh Kumar in collusion with the petitioner, the then Agriculture Coordinator and Sri Abhimanyu Kumar, Farmer Advisor committed irregularities in payment of compensation for damaged crops in the financial year 2014-15. It has been submitted by learned counsel for the petitioner that only duty assigned to the Agriculture Coordinator (petitioner) was to put his signature on the report produced by the Farmer Advisor for payment of damaged crops. Patna High Court Cr.Misc. No.18065 of 2017 (02) dt.14-06-2017 - 2 - Agriculture Officer, Nalanda in enquiry found the laches on the part of Sri Abhimanyu Kumar, the then Farmer Advisor. One coaccused Rajesh Kumar has already been enlarged on bail by a coordinate Bench of this Court in Cr. Misc. No.2487 of 2017 vide order dated 02.03.2017.

Considering the facts aforesaid and the nature of allegation as made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000.00 (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Biharsharif at Nalanda in Sarmera P.S. Case No.118 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
