In this case, the petitioners are seeking anticipatory bail in connection with Basopatti Police Station Case No. 202 of 2017 registered for offences punishable under sections 147, 149, 341, 333, 324, 307, 379, 427 and 504 of the Indian Penal Code.
Allegation has been made that all the accused persons armed with different weapons came to the house of the informant and assaulted him. Allegation has been made that Pradip Yadav armed with Dabiya, Nand Lal Yadav and Ram Sundar Yadav armed with Farsa started assaulting the informant and his family members. Patna High Court Cr.Misc. No.78977 of 2018(2) dt.09-01-2019 2/3 assaulted the victim. The allegation against Harshit Yadav, Ram Uddgar Yadav, Parichhan, Sujit Kumar Yadav, Rajdev Yadav, Sanjay Yadav and Arun Yadav is that they were involved in fleeing away the cattle and when the informant resisted then they have broken his house.
It has been submitted that there is nothing against these petitioners. They have clean antecedent. The Police submitted Final Form in this case.
Looking to the facts and circumstances of the case, the prayer for bail of the petitioners is allowed and they, in the event of arrest or surrender before the court below within six weeks from today, are directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of 5th Additional Chief Judicial Magistrate, Madhubani in connection with Basopatti Police Station Case No. 202 of 2017, subject to the conditions as laid down under section 438 Cr. PC and also subject to the condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court The petitioners will not induce any witness or tamper with the evidence.
