2. The petitioner seeks bail in connection with Palasi P.S. Case No. 244 of 2024 registered for the offences under Sections 20 and 22 of the NDPS Act and under Sections 317(2), 303(2) of the Bhartiya Nyay Sanhita, 2023.

3. As per the FIR, it is alleged that there is recovery of 29.600 liters of codeine rich cough syrup from the petitioner.

4. The petitioner is in custody since 15.7.2024 and the petitioner claims to have clean antecedent.

5. It has been submitted by the learned counsel for the petitioner that the charges have been framed in this case but no witnesses has been examined in this case.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge-IV, Araria/concerned Court below in connection with NDPS P.S. Case No. 99 of 2024 arising out of Palasi P.S. Case No. 244 of 2024, subject to the condition that the bailors should be close blood relative of the petitioner.

As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.

9. As the petitioner claims to have clean antecedent, the Court below, before accepting the bail bonds of the petitioner is directed to verify the antecedent of the petitioner. If the petitioner is found to be involved in any other case then the bail bonds of the petitioner shall not be accepted. (Sandeep Kumar, J) Vikas/- U
