The petitioner in the present case is apprehending his arrest in Athmalgola P.S. Case No. 79/2016 registered under Sections 363 and 366(A) of the Indian Penal Code. A bare perusal of the First Information Report would show that there is an allegation of active participation of the present petitioner in kidnapping of the minor girl. Learned counsel for the petitioner would submit that the name of the petitioner has been falsely implicated in the present case on mere suspicion. The learned A.P.P. opposed the prayer for anticipatory bail referring to the statement made under Section 164 of the Code of Criminal Procedure and submits that the girl has made a statement after her return in which she has named the present petitioner also.
In the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail is refused.
If the petitioner surrenders in the court below within four weeks from today and prays for regular bail, the same shall be considered on its own merit on the basis of the materials available on the record.
