The petitioners are apprehending their arrest in connection with Daudnagar P.S.Case nO.302 of 2018 , registered for offences punishable under Sections 147, 148, 149, 323, 353, 332, 333, 109, 504, 342 of the Indian Penal Code. Allegation against the petitioners is that when the police went for removal of encroachment several accuse persons named in the FIR including the petitioner tried to obstruct and started pelting stones.

Submission of the learned counsel for the petitioners is that they were only villagers and the police had not went for removal of the encroachment and several accused persons who were instigation have already been granted privilege of the

Patna High Court Cr.Misc. No.78786 of 2018(2) dt.11-01-2019 2/2 anticipatory bail, vide order dated 20.2.2018 passed in Cr. Misc. No.72291 of 2018 and there is no specific allegation against the petitioners.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Daudnagar, in connection with Daudnagar P.S.Case no.302 of 2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation of the case..

With the aforesaid observation, this application is allowed.
